WHAT IS ARBITRATION ?
Arbitration is an alternative dispute resolution method. Parties have agreed to submit their case to an arbitral tribunal composed of one to three persons. On the basis of the request of the parties, the tribunal will render a decision, an arbitral award, which is obligatory. This award can be enforced if needed.
WHY TURN TO ARBITRATION ?
THE QUICKNESS OF THE PROCEDURE An arbitration procedure for disputes of limited financial importance lead by CEPANI lasts in average 4 months. This can be explained by the fact that : 1) there is always a sole arbitrator 2) there is no obligation to draw-up the Terms of Reference, 3) the procedure is mainly written, 4) the fact that the arbitral award is final and not subject to appeal, 5) the availability and expertise of the arbitrator.
CONFIDENTIALITY Contrary to the proceedings lead in ordinary courts, arbitration is strictly confidential. The arbitrators shall show the utmost discretion; when the parties are heard the hearings are not public and the arbitral award is only published with the permission of the parties.
COSTS CEPANI’s arbitration costs for arbitration of disputes of limited fiancial importance vary between 625,00 EUR and 1.250,00 EUR.
TRUSTWORTHY ATMOSPHERE The procedure generally takes place in a trustworthy atmosphere which enables to save the parties relations.
