Brexit-related commercial disputes and possible ADR solutions

In the context of the legal uncertainty raised by Brexit for ongoing and future contracts involving a British party, sustaining business might request to handle possible disputes resulting from unforeseeable consequences of Brexit in a subtle way.

While a well drafted hardship clause may offer a ground, when present, to renegotiate the contract or if the parties fail to reach a new agreement, to terminate the contract, it could be generally advisable to consider some of the options offered by alternative dispute resolution instead of opting for litigation.
