For a long time, arbitrators have been using secretaries in the performance of their duties. More recently, trained lawyers have been engaged in assisting arbitrators to discharge these duties. This book analyses this development from the perspective of transparency and discusses the pros and cons of a business model in which arbitral secretaries are used. It also provides a legal analysis under Belgian and Dutch law of the various relationships that emerge as a result of the use of arbitral secretaries i.e. the relationships between the arbitral secretary and the arbitrators, between the arbitral secretary and the parties to an arbitration and between the arbitral secretary and arbitral institutions. In addition, the book describes the rules of various arbitral institutions and scans case law regarding the use of arbitral secretaries from different perspectives: their appointment and remuneration, their independence and impartiality and above all the scope of their activities in relation to the core decision making functions of arbitral tribunals. The book concludes with the perspectives of arbitral institutions and of arbitrators regarding the use of arbitral secretaries including the approach taken by CEPANI, NAI and ICC.

Bijdragen aan het colloquium van CEPANI van 12 januari 2017

This book regroups the presentations rendered at the CEPANI40 conference on 20 October 2015 putting the spotlight on counsel as one of the crucial actors/interlocutors in arbitration. The book and conference continue a tradition started by its co-founders in 2006 of focusing in a very practical manner on various trending aspects of the arbitral process.

Most recently the interest in and attention to counsel behavior in arbitration emerged, notably from an ethical point of view. This not surprising considering the multifaceted nature of this legal profession, in which counsel bear legal, professional and moral responsibility vis-à-vis clients, the arbitral tribunal, colleagues, the legal community and society at large. The first part of this book is therefore specifically dedicated to ethical questions regarding counsel conduct in arbitration.

b-Arbitra, the Belgian journal for arbitration, is an initiative of CEPANI, the Belgian Center of Arbitration and Mediation. The biannual journal is unique in that it welcomes contributions in English, as well as in Belgium’s official languages Dutch, French and German. Each of these articles is accompanied by a summary in the English language.

b-Arbitra subscribes to the objective of CEPANI to promote edifying debate and in-depth research in the field of arbitration, to provide a valuable source of pertinent information to lawyers involved in arbitration, and to bring new developments to policy makers’ attention in order to further the quality of arbitration law and practice. It promotes dialogue on novel issues in the field of arbitration and aims to provide a dynamic forum for the exchange of information on a European scale, in light of the increasing number of cross-border disputes and the internationalization of arbitration.

Daarnaast koestert het Centrum ook de ambitie om de aantrekkelijkheid van arbitrage te vergroten, zowel in België als internationaal, door in te zetten op een grotere bekendheid van de arbitrale procedure en van het desbetreffende reglement.

De geselecteerde arbitrale uitspraken zijn voorzien van commentaren door ervaren vakmensen en gespecialiseerde academici in het Engels, Frans of Nederlands, inclusief een samenvatting in de twee andere talen. Een index van sleutelwoorden vergemakkelijkt de raadpleging van het werk.

CEPANI offers a brochure kit on the topic of ‘Brussels, the European Arbitration Hub’. The initiative for this kit came from the study group of the same name, which has worked to promote not only CEPANI, but more generally Brussels and Belgium internationally, as a place of arbitration.

One of CEPANI’s goals is to actively promote the knowledge and use of arbitration a.o. by encouraging the study of arbitration on a national and international level. Without a doubt, our young professionals take up a central spot in the elaboration of this mission. To support this young talent in particular, CEPANI takes great pride in organizing an Academic prize which rewards an outstanding paper in the field of national or international arbitration.

The goal of this competition is to offer young professionals with an interest in the field the chance to gain recognition among their peers.

CEPANI’s Academic Prize, which amounts to € 5.000, is awarded every three years. The competition is open to anyone who is under the age of 40 on the 1st of September of the year in which the prize is awarded, i.e. 1st of September 2021.  The works shall be sent to the Secretariat of CEPANI by December 1st of the year of the award. For this edition, December 1st 2021.
